Terms and Conditions for the Use of Personal Data

The personal data to which BLUMARKETER S.A.C. will have access will be that which the User voluntarily provides by completing the forms made available for that purpose.

BLUMARKETER S.A.C. provides its Users with the appropriate technical resources so that they become aware of these Terms and Conditions for the Use of Personal Data, the entry of Personal Data or confidential information on the website constituting the express expression of their consent to these Terms and Conditions.

By accepting, you authorize BLUMARKETER S.A.C. to use the data you register through this website powercheck.app, for the following purposes:

• Provision or offering of services provided by BLUMARKETER S.A.C., by any of the units of BLUMARKETER S.A.C. or by third parties with which an agreement has been signed, for which we may share your information exclusively for the purposes described here and always guaranteeing the security of your personal data.
• Handling inquiries, presenting products and inviting you to events organized by BLUMARKETER S.A.C.
• Maintaining the customer register.
• Conducting surveys.

In general, for any purpose related to your relationship with BLUMARKETER S.A.C.

Your information will be stored in a database owned by BLUMARKETER S.A.C. and will be used directly by BLUMARKETER S.A.C., by any of the units of BLUMARKETER S.A.C. or by third parties with which an agreement has been signed where necessary, always guaranteeing the security and confidentiality of that information.

The user acknowledges and accepts that PowerCheck uses artificial intelligence techniques to generate evaluations and recommendations. These evaluations are informational and educational in nature, and do not replace human analysis or decision-making. BLUMARKETER S.A.C. guarantees that the use of AI in its services complies with Ley N.° 31814, the Regulation approved by D.S. N.° 115-2025-PCM and Ley N.° 29733 – Ley de Protección de Datos Personales.

Data will be kept for as long as the relationship with the user lasts and for a maximum of 10 years after the last interaction, unless the user requests deletion earlier.

The authorization you grant is for an indefinite period; however, it may be revoked, or any of the rights provided for in the policy may be exercised, as governed by Peruvian law and in particular by:

• Ley N.° 29733 – Ley de Protección de Datos Personales.
• Decreto Supremo N.° 003-2013-JUS, which approves the Regulation of Ley N.° 29733.
• Directiva de Seguridad de la Información, approved by Resolución Directoral N.° 019-2013-JUS/DGPDP.

If the User is located in a country other than Peru, BLUMARKETER S.A.C. guarantees that the processing of their personal data will be carried out in accordance with the principles and obligations established by the applicable local legislation and by this policy.
