1. Identity of the Data Controller

BluMarketer S.A.C., RUC 20606706899, domiciled in Lima, Peru, is the controller of the personal data that users provide through the website powercheck.app.

2. Personal data collected

When using PowerCheck, we may collect the following data:

• Account data: name and email address. If you sign in with Google, we also receive your Google account identifier. If you register with a password, we store it in encrypted form.
• Project data: city and country where the project operates, general information about the business idea entered in the forms, and the results of the evaluations generated.

In no case do we request or process sensitive data (health, religion, political orientation, etc.).

3. Purpose of processing

Your personal data will be used for:

• Providing the PowerCheck service and access to evaluation results.
• Access to PowerHub, in the case of incubators or organizations with an agreement.
• Producing metrics and results indicators.
• Handling inquiries and user support.
• Invitations to events, commercial communications and sending information about PowerCheck and BluMarketer S.A.C. (if the user authorizes it).
• Compliance with legal and contractual obligations.

4. Use of Artificial Intelligence

The user acknowledges that PowerCheck uses artificial intelligence techniques to process the information entered and generate evaluations. These evaluations are informational and educational in nature and do not replace human analysis or decision-making.

BluMarketer S.A.C. guarantees that the use of AI complies with Ley N.° 31814, the Regulation approved by D.S. N.° 115-2025-PCM and Ley N.° 29733 – Ley de Protección de Datos Personales.

5. Data retention

Personal data will be kept for as long as the relationship with the user lasts and for a maximum of 10 years after the last interaction, unless the user expressly requests deletion.

6. User rights (ARCO)

The user may exercise the rights of:

• Access to their data.
• Rectification of inaccurate data.
• Cancellation or deletion of their data.
• Opposition to the processing.

To exercise these rights, the user must write to: administrador@blumarketer.com.

7. International transfer and storage

Data may be stored and processed on servers located outside Peru, with international technology providers such as Supabase, Inc. (database), Render Services, Inc. (application server), Vercel Inc. (website hosting), Google LLC (sign-in with Google) and OpenAI (artificial intelligence processing of the information entered in the evaluations), among others.

BluMarketer S.A.C. guarantees that these providers meet high standards of security and confidentiality.

8. Security measures

BluMarketer S.A.C. adopts the technical, organizational and legal measures necessary to protect personal data against loss, misuse, unauthorized access or improper disclosure.

This includes secure authentication, encrypted passwords and storage on trusted platforms.

9. Disclosure of data to third parties

Personal data will not be sold or transferred to unrelated third parties, except:

• Incubators, institutions or government entities with which BluMarketer has agreements, solely for statistical or reporting purposes.
• Technology providers that supply storage and processing services (Supabase, Render, Vercel, Google, OpenAI, etc.), under strict confidentiality conditions.

10. Changes to this policy

BluMarketer S.A.C. may modify this Privacy Policy at any time. The current version will always be available at powercheck.app/politica-privacidad.
